Tennessee is an equitable distribution state, not a community property state. This means the court divides marital property "fairly," which does not always mean a perfect 50/50 split. The court looks at the length of the marriage, the contribution of each spouse (including homemaking), and each person’s economic circumstances.

Not necessarily. Most divorces in Nashville are filed on "Irreconcilable Differences" (no-fault). However, you can still file on fault-based grounds (like adultery, inappropriate marital conduct, or desertion). Proving fault can sometimes influence alimony or the division of property, but it is no longer required to simply end the marriage.

In Tennessee, there is no specific age where a child has the absolute "right" to choose. However, if a child is 12 years of age or older, the court must consider the child’s reasonable preference. The older and more mature the child, the more weight the judge typically gives their opinion.

Usually, yes. Tennessee uses the "Income Shares Model." Even with equal time, if one parent earns significantly more than the other, they will likely still pay child support to ensure the child maintains a similar standard of living in both households.

Attorneys almost universally advise against it. Technically, dating before the final decree is signed is still considered adultery under Tennessee law. Even if it doesn't "stop" the divorce, it can complicate custody battles and may give the other spouse leverage in settlement negotiations.

  • In Solido: A lump-sum payment.

Tennessee has a strict Parental Relocation Statute. If you want to move more than 50 miles away (or out of state), you must send a formal certified letter to the other parent at least 60 days in advance. If they object, you will likely have to go to court to prove the move is in the child’s best interest.
